Welcome to Kitawolf Studios. These terms and conditions outline the rules and regulations for the use of Kitawolf Studios's website and software products (including applications, plugins, and games).

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Kitawolf Studios if you do not agree to take all of the terms and conditions stated on this page.

1. Definitions & Scope

The following terminology applies to these Terms of Service, Privacy Statement, and Disclaimer Notice:

  • "Client", "You", and "Your" refers to you, the person logged onto this website and compliant to the Company's terms and conditions.
  • "The Company", "Ourselves", "We", "Our", and "Us" refers to Kitawolf Studios.
  • "Services" refers to the applications, plugins, games, custom software, and website content provided by us.

2. Software Licensing (Plugins & Code)

Unless otherwise stated, software products distributed by Kitawolf Studios are governed by the following licensing conditions:

  • WordPress Plugins: Our WordPress plugins are generally licensed under the GNU General Public License (GPL) version 2.0 or later, matching the WordPress Core framework. However, access to automatic plugin updates, support portals, and add-on services requires a valid, active license key purchased through our store.
  • Applications & Games: Unless explicitly accompanied by an open-source license, all applications, source code, game assets, logic, and games compiled or distributed by us are proprietary to Kitawolf Studios. You are granted a personal, non-exclusive, non-transferable, revocable license to run the software on compatible devices solely for your personal or authorized business use.

3. Purchases, Payments & Merchant of Record

We sell our plugins and software licenses through our online storefront, which uses Lemon Squeezy as our Merchant of Record (MoR).

  • Transaction Handling: When you purchase a license key, transaction fees, VAT, tax calculations, and billing support are handled directly by Lemon Squeezy. By completing a transaction, you agree to Lemon Squeezy's customer terms of service in addition to our terms.
  • Subscriptions & Renewals: Certain products are sold on a recurring subscription basis. You will be billed automatically at the end of each subscription period. You may cancel your subscription at any time via your Lemon Squeezy billing portal.
  • Refund Policy: We offer a 14-day refund window on software license keys if the software fails to perform as described or is incompatible with your system, provided you collaborate with our support team to troubleshoot first. Refund requests are subject to verification and are initiated via Lemon Squeezy.

4. Custom Software Specifications

For custom engineering and bespoke development contracts, terms of work, milestones, delivery dates, and transfer of intellectual property will be governed by a separate, signed **Software Development Agreement** between Kitawolf Studios and the customer. These website terms do not supersede such signed contracts.

5. Intellectual Property Rights

Other than GPL-licensed plugin code, Kitawolf Studios and/or its licensors own all the intellectual property rights and materials contained in this Website and our proprietary software. All intellectual property rights are reserved. You must not:

  • Republish material from Kitawolf Studios (excluding GPL-licensed files).
  • Sell, rent, or sub-license material from Kitawolf Studios (excluding GPL-licensed files).
  • Reproduce, duplicate, or copy proprietary assets or art from our games and applications.

6. Limitation of Liability

In no event shall Kitawolf Studios, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of our software or website. Kitawolf Studios, including its officers, directors, and employees, shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this Website or our products (such as website downtime, database crashes, or search ranking fluctuations due to third-party integrations).

7. Disclaimer of Warranties

Our website and software are provided "as is," with all faults, and Kitawolf Studios expresses no representations or warranties of any kind related to this Website or the materials and software contained on it. Also, nothing contained on this Website shall be interpreted as advising you.

8. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the country and state in which Kitawolf Studios operates, and you submit to the non-exclusive jurisdiction of the state and federal courts located in that region for the resolution of any disputes.
